緊急事態条項 権利制限、細田氏に一任 大規模災害想定

自民党憲法改正推進本部は7日、全体会合を開き、緊急事態条項の創設について議論した。推進本部役員は、2012年の党憲法改正草案より国民の権利制限を抑制した条文案を提示。首相に強い権限を認める12年草案を支持する意見も出て結論には至らなかったが、対応を一任された細田博之本部長は、権利制限を抑えた最終案を25日の党大会までにまとめる。

 全体会合では、(1)12年草案(2)12年草案の修正案(3)議員任期延長と緊急政令など緊急措置を認める案(4)議員任期延長に絞った案(5)四つの案を集約した案--の5案が示された。

 細田氏ら幹部は5番目の案で意見集約したい考えだ。この案は、大地震など大規模災害で法律の制定や予算の議決が間に合わない「特別の事情」が生じた場合、国民の生命、身体、財産を保護するために内閣が政令を制定できると規定。財政上の支出や、移動の自由の制限も可能にする。

 国政選挙の適正な実施が困難になった際には、衆参各院の出席議員の3分の2以上の賛成で議員任期や選挙期日に特例を設ける。任期延長の限度は引き続き検討する。

 12年草案は緊急事態を「外部からの武力攻撃、内乱、大規模な自然災害」などと定義。首相が緊急事態を宣言すれば、内閣は法律と同一の効力を有する政令を制定でき、国など公の機関の指示に「何人も従わなければならない」と規定した。しかし、他党や憲法学者らには「基本的人権の制約につながる」という批判が根強い。細田氏は会合で「国民の理解を得て、各党とも合意形成できるような形が望ましい」と述べた。【田中裕之、小田中大
